Freedom for Eurasia Statement On the UN Working Group Petition Concerning Tilekmat Kudaibergen uulu

Freedom for Eurasia supports the petition submitted on 4 May 2026 to the UN Working Group on Arbitrary Detention by Freedom Now and Hausfeld LLP concerning Kyrgyzstani civic activist Tilekmat Kudaibergen uulu. The submission raises grave concerns regarding a pattern of transnational repression culminating in his unlawful transfer from the United Arab Emirates to Kyrgyzstan and his ongoing deprivation of liberty.

Kudaibergen uulu—an outspoken critic of government policy and an environmental activist—was apprehended in Dubai in April 2025 without a warrant, held incommunicado, and forcibly transferred to Kyrgyzstan outside any formal extradition framework . This sequence of events is consistent with what international human rights mechanisms have characterized as “extraordinary rendition,” a practice that circumvents judicial safeguards and violates fundamental guarantees under international law.

Freedom for Eurasia has consistently documented similar patterns across Central Asia, where authorities increasingly extend repression beyond their borders to target dissenting voices. The case of Kudaibergen uulu is emblematic of this trend: a political activist who, after seeking refuge abroad and registering as an asylum seeker, was nevertheless pursued, deceived, and ultimately returned through opaque and unlawful means.

The charges brought against him—reportedly including allegations related to inciting unrest and attempting to seize power—appear to rest on broadly framed provisions that have been repeatedly used to criminalize peaceful political expression and civic mobilization. As the petition underscores, his prosecution follows a history of reprisals linked to his criticism of government policies, including constitutional reforms and environmental decisions surrounding the Kempir-Abad reservoir.

His continued pre-trial detention, prolonged without adequate justification and accompanied by reports of deteriorating health, raises serious concerns under international standards, including the right to liberty, fair trial guarantees, and protection from arbitrary detention. The Working Group has previously found that similar patterns—where detention is linked to the exercise of fundamental freedoms—fall squarely within its categories of arbitrary detention.

This case must also be viewed within the broader context of a deteriorating human rights environment in Kyrgyzstan. As reflected in international reporting and prior UN findings, there has been a marked increase in pressure on independent media, civil society actors, and political opponents, including the use of criminal law to suppress dissent.

Freedom for Eurasia calls on:

  • The Government of Kyrgyzstan to immediately release Tilekmat Kudaibergen uulu, drop charges incompatible with international human rights standards, and ensure full respect for due process guarantees;
  • The Government of the United Arab Emirates to clarify the circumstances surrounding his apprehension and transfer, and to ensure that similar violations—particularly involving asylum seekers—do not recur;
  • International partners, including the European Union and UN mechanisms, to treat this case as indicative of a broader pattern requiring a coordinated response.

The case of Tilekmat Kudaibergen uulu is not an isolated incident. It reflects an increasingly entrenched model of repression that disregards borders, undermines asylum protections, and erodes the integrity of international legal safeguards. Addressing it decisively is essential not only for the protection of one individual, but for the preservation of the broader human rights framework.
